Participant::This unfortunate woman was born with spina bifida. She sued her mother’s doctor for a “wrongful conception” claim over his failure to advise her mother to take vital supplements before getting pregnant…and she won…millions…The article is below, and I still am in disbelief!

Participant::There is no guarantee that taking vital supplements before getting pregnant would alleviate the issue, unless the environment was 100% controlled in diet, exercize, supplement, environment, and sleep 24 hours a day. This is not possible in a free-will society, and does not lend itself to marginal error due to biologic differences. Hence, the affliction is not maintainable with a controlled outcome and therefore, not likely to have warranted the legal outcome on appropriately educated grounds. “Do no Harm”, implies the validation of “intent to do no harm” and is exclusive of negligence, etc. Patient history with margin of error, direct assessments, behaviors,observations all play their role, but are only as good in treatment as the effectiveness of client teachings, perceptions and follow through. If the patient was given supplements what is the likelyhood that it were followed perfectly without error? and what is the likelihood that lack of supplements was the only underlying element resulting in the disease…it is not a guaranteed outcome! It’s a stupid lawsuit!

Participant::This is totally a weird decision of court. There is nothing 100% that supplements during pregnancy would have stopped spina bifida and it’s consequences. Moreover, terminating pregnancy is mothers right and doctors cannot impose any pressure on her. They can just inform that child may have inborn anomalies which may have various severity.

Participant::What if it was the mother’s failure to comply and adhere to the prescribed perinatal drugs?
And risks of Congenital abnormalities are reduced by taking the vital supplements not controlled at 100%. Bse still some mothers give birth to babies with CAs
Even after complying and adhering.The court ruling wasn’t analytical enough to identify the actual cause of the abnormality.

Participant::on what basis? The supplements showed a decrease in the incidence of neural tube defects. But this was not without 100s of confounding factors. This has never been set as cause and effect, no study with such proof because it is impossible to control human beings on what they eat, what environment they are exposed to and most of all, their genetic make up. It is unfortunate the girl got this devastating anomaly, but it is never the physician’s fault.
